Aadhar hearing: SC asks Bengal govt how can a state challenge a law passed by the Centre

New Delhi, October 30: It is a very common trend of Bengal Chief Minister Mamata Banerjee to oppose almost every direction or decision taken by the Central government. Recently on the direction of linking Aadhar to mobile no. and making it mandatory for giving citizens social benefits, Mamata Banerjee told she would not conceit Aadhar on any condition. Later Bengal Government moved to Supreme Court opposing the direction. SC observed state cannot question laws passed by the parliament.

“Under no circumstances will I link Aadhaar with my telephone number. If the authorities disconnect my phone, let them do it. It will actually save me a lot of trouble as I won’t have to go through a number of text messages,” Bengal CM said earlier.

Though Supreme Court has slammed Bengal govt. for moving to Supreme Court, it left the chance the West Bengal CM to approach the court as an individual. As West Bengal government challenged the decision to link Aadhar to West Bengal government schemes. Though the petition is filed through the Chief Secretary of West Bengal, the apex court said Mamata Banerjee can challenge the decision.

“In a federal structure, how can a state file plea challenging Parliament’s mandate? We know it is a matter which needs consideration but you satisfy us how a state can challenge it?” it asked.

The petition was heard by a bench comprising Justices A.K. Sikri and Ashok Bhushan. The SC has issued a notice to Centre, asking it to file a response within 4 weeks.
