End to a long conflict: Kenyan Supreme Court upholds President Uhuru Kenyatta’s victory

Nairobi, November 20: Like Zimbabwe, another African country Kenya is also facing political turmoil since its last Presidential election in August 2017. Cancellation of presidential Poll, a re-run of the poll, appeal to cancel out re-run- a series of events kept the country tensed. Finally, Kenyan Supreme Court upheld the re-election of Uhuru Kenyatta in latest re-election.

The re-run of the election was avoided by oppositions due to an allegation of lack of proper system by Kenyan Election Commission. Later President Uruhu Kenyatta won the re-run on October 26. Two separate petitions, that of Harun Mwau and that of Khelef Khalifa and Njonjo Mwau, were filed by Human right activists. A six-member division bench dismissed the plea.

“The court has unanimously determined that the petitions are not merited and the final orders are that the petition by John Harun Mwau versus the Independent Electoral and Boundaries Commission and two others as consolidated is hereby dismissed.” Chief Justice David Maraga said.

“The petition by Njonjo Mue and another versus the Chairperson of the Independent Electoral and Boundaries Commission and three others as consolidated is also hereby dismissed. As a consequence, the presidential election of October 26 is hereby upheld as is the election of Uhuru Kenyatta,” Chief Justice added.

In August’s 1st election when President Uhuru Kenyatta was declared the winner of the election, the result prompted celebration and violence instantly. Later Kenya’s Supreme Court canceled the validity of Kenyan President Uhuru Kenyatta’s win as President and ordered for a re-run.
