Ahmedabad, September 22: On a petition filed by BJP candidate Balwantsinh Rajput against Congress leader Ahmed Patel challenging his victory in recently-held Rajya Sabha elections, the Gujarat High Court has asked Patel to file his reply within two weeks. Both have contested against each other in Gujarat Rajya Sabha election 2017.

On a request made by Patel's lawyer, the court Justice Bela Trivedi on Thursday postponed the hearing to 6th of October seeking more time to file the affidavit in response to the petition.
The BJP candidate Rajput was a Congress MLA who had quit the party before the Rajya Sabha elections held on 8th August for three seats. After rejecting votes of two dissident MLAs of the main Opposition party for violating electoral rules, Ahmed Patel defeated Balwantsinh Rajput in Rajya Sabha election in a bitterly fought battle.
By Rejecting votes of two Congress MLAs Raghavji Patel and Bholabhai Gohel the requirement for majority slipped to 44 from 45. Ahmed Patel secured 44 against Rajput’s 38.
According to the rules, voters for the Rajya Sabha elections have to show their ballots to the authorized representative of their respective parties before casting them. Votes of two Congress MLAs discounted as they had also shown their ballot papers to unauthorized persons.
