SC rejects SIT probe into Judge Loya death case

New Delhi, Apr 19: The Supreme Court Thursday rejected the petitions seeking further enquiry into the death of Justice Brijmohan Harikishan Loya of the special CBI court. The Supreme Court ruled that the death of judge Loya was due to natural causes.

The apex court further noted that the petitioners tried to ‘scandalize’ the judiciary in this case.

Dismissing petitions seeking independent probe into the death of Judge Loya, the apex court observed that the death of Judge Loya was due to ‘natural causes’ and further observed that the petitioners tried to scandalize the judiciary.

The three-judge bench of the Supreme Court headed by Chief Justice Dipak Misra, and Justices A M Khanwilkar and D Y Chandrachud pronounced this verdict after hearing a bunch of petitions.

According to the records Jude Loya died in Nagpur of a heart attack on December 1, 2014. The petitioners moved the apex court alleging that the judge dies under ‘mysterious’ circumstances. He was hearing the case of ‘fake encounter’ related to SOharabuddin Sheikh. BJP National President Amit Shah is named as one of the accused in this case but was later acquitted.

Heated exchanges were witness during the hearing of the case between the counsels of the petitioners and the State of Maharashtra. The petitioners had raised doubts over the curcumstances surrounding the death of Judge Loya, while the counsel for Maharashtra had called the claim as ‘motivated’.

Meanwhile, the BJP spokesman Dr Sambit Patra had said that the petitions were politically motivated and thanked the Supreme Court for rejecting the politically-motivated petitions. Dr Patra alleged that the Congress was losing graound and hence indulging in such activities.
 
Some people were trying to use the judiciary for political purposes, Dr Patrea Said adding that with the Supreme Court decision they are exposed before the people.
