Ahmedabad, May 30: The Metropolitan Magistrate of Ahmedabad has rejected the application filed by Medha Patkar on 18.06.12 for a probe by a Special Investigation Team (SIT) under section 173(8) of CrPC in to the incident of an alleged assault on her at Sabarmati Ashram in 2002.
On 26th March, 2013, Court reserved the order after hearing the Counsel of Patkar as well as Ajay Choksi, Advocate, who appeared for V.K.Saxena, President, National Council for Civil Liberties, Ahmedabad and Govt Advocate, A.S.Nayak. The Court in its detailed order rejected the grounds taken by Patkar for re-investigation of the case.
Patkar alleged that during a public meeting at Sabarmati Gandhi Ashram on March 7, 2002 convened to condemn 2002 riots, a mob of BJP youth wing workers protesting the presence of Patkar allegedly attacked the gathering. Patkar claimed that during the incident, some leading social activists from Gujarat and members of the media were also injured with Patkar.
A complaint was registered at Sabarmati Police Station and charge sheet was filed in the same year.
Choksi and Nayak opposed Patkar’s application for further probe on the grounds that it was filed after a gap of 10 years; much after the Court has started recording the evidence in the case. V. K. Saxena who was present in the Court on last hearing on 26 March submitted through his Counsel Choksi that Patkar is not serious to pursue this case as during the last ten years she has appeared only once on 18 June 2012 to submit this application despite various summons issued by this Hon’ble Court.
Choksi also pleaded that his client’s name has been deliberately dragged by the complainant in her complaint because he has exposed her ‘anti-national activities’. Saxena was not involved in any type of assault on her and this application is to further drag the matter for several years in turn harassing his client.
BJP leaders Amit Thaakar, Amit Popatlal Shah and Congress leaders Hemant Chauhan and Rohit Patel are other accused in this case.
Meanwhile recently on 6 April 2013 a Delhi Metropolitan Court has imposed a fine of Rs 15,000 on Medha Patkar in the cases filed by V.K.Saxena against her for not appearing in the Court despite repeated summons.
