Vice President Venkaiah Naidu rejects impeachment of CJI after Congress shamelessly insulted ‘judiciary’

New Delhi, April 23: Vice President Venkaiah Naidu who is also a Chairman of Rajya Sabha has rejected the impeachment motion of Chief Justice of India (CJI) Dipak Misra which was brought in by Congress and its allies.

 

Notably, Congress and its allies in a bid to target PM Modi led central government shamelessly brought in the impeachment of Chief Justice of India (CJI) Dipak Misra and insulted judiciary and judicial system of the country. However, taking a cognizance in this, Rajya Sabha Chairman Venkaiah Naidu rejected the impeachment motion of CJI.

Venkaiah Naidu after consulting to senior officials including Attorney General KK Venugopal, former Supreme Court judge B Sudershan Reddy, former Lok Sabha Secretary General Subhash Kashyap, former Law Secretary PK Malhotra, former Legislative Secretary Sanjay Singh and officials of Rajay Sabha Secretariat over the issue rejected the impeachment motion.

The Vice President in the order said, “I have considered each of the allegations individually as well as collectively in the light of annexures annexed to the notice to the motion but also in the light of cogent, relevant material available in the form of judicial orders passed by the apex court of the country. Based on all this, I have come to conclusion that this motion does not deserve to be admitted.”

The Rajya Sabha chairman also stated that the allegations made in the notice have a tendency to undermine the independence of the judiciary.

“Going through the five allegations mentioned in the notice, I am of the view that they are neither tenable nor admissible. The allegations emerging from the present case have a serious tendency of undermining the independence of judiciary which is the basic tenet of the Constitution of India. Considering the totality of facts, I am of the firm opinion that it is neither legal nor desirable or proper to admit the Notice of Motion on any one of these grounds,” VP Naidu stated in his order.

 

On Friday, Congress and six other opposition parties had moved a notice for the impeachment of the Chief Justice of India accusing him of five counts of misbehaviour and misusing authority. The notice carried signatures of 71 MPs. However, seven of the lawmakers have stepped down since, but the number of signatures is still well above the mandatory 50.

Earlier, the Congress leaders have said that if the motion is not accepted by the Vice President then they will approach the Supreme Court. On the other side, BJP has slammed Congress for insulting judiciary and called it a revenge petition, accusing the opposition and its allies of using impeachment as a political tool.
