Many wow factors in reforms of labour law added; Laws amended from enhanced bonus limit to maternity leaves

New Delhi, December 19: Change is the need of the hour and if this change is related to common man then it’s definitely a win-win situation. Labour laws in India have given beneficiaries to the people and have been trying to make valuable amendments. Thus to cater the needs of the people the government has decided to make some reforms in the labour laws in the legislative assembly. The Ministry has taken some important measures in simplifying, merging and rationalizing the relevant provisions of Central labour Law. The Ministry has also drafted the Labour law codes on Wages, Industrial Revolution, Social Security & Welfare and Occupation Safety, Health and Working Conditions respectively. Union Minister of State for Labour and Employment Santosh Kumar Gangwar told this to Lok Sabha Monday.

The Labour Law code on Wages was earlier introduced in the Lok Sabha on 10th August, 2017. The other Labour Law codes are at the pre-legislative consultative stage. The procedure of legislative reforms of labour comprises of consultation with the stakeholders including Central Trade Unions, Employer’s Association and State Governments in the form of tripartite consultation. The suggestions and comments generated by this tripartite consultation are then used for finalizing the amendments of various acts.

There are some initiatives taken by the Legislative Assembly on the Labour Law in the past 3 years. Some of the beneficial amendments by the legislative assembly are as follows:

  • The eligibility limit of payment of bonus has been boosted from 10,000/- to 21,000/-
  • Enabling the wages to the employer’s by cash or cheque to directly transfer it to their bank accounts.
  • A complete ban on employment of children below the age of 14 years.
  • Maternity leaves payment increased from 12 weeks to 26 weeks.
These reforms are made to make things more effective, flexible, and sync in with the economic and industrial scenario. The labour law is however divided into four or five Labour Codes of functional basis by the Second National Commission on Labour.
