SC condemned “all form” of mob-lynching; urges Parliament to enact separate law to deal with offence

New Delhi, July 17: Supreme Court on Tuesday condemned all forms of mob-lynching incidents across the country and urged the Parliament to enact a separate law to deal with the offence of lynching.

 

Today’s judgment comes on a writ petition filed by Congress leader Tehseen Poonawalla and Mahatma Gandhi’s great-grandson Tushar Gandhi, in the light of the rising instances of cow vigilantism.

It is worth to mention here that the judgment of Supreme Court has not at all referred cow vigilantism in its verdict. The SC has ordered on all subjects upon which the heinous crime of mob lynching is carried. However, some section of media and political parties are spreading false input and rumors through linking the judgment of SC only with the 'cow vigilantism' for their own ‘propaganda’ and earn political mileage and power.

Notably, a Bench of Chief Justice Dipak Misra and Justices AM Khanwilkar and DY Chandrachud before giving the decision said that the horrendous acts of mobocracy cannot be allowed to become a new norm in the Country.

“No citizen can take the law into his hands or become a law on to himself,” said the bench. It is the duty of the States to ensure that law and order is maintained so as to protect the secular ethos and Constitutional values, the apex court ruled while stressing on the need to contain mobocracy.

The Supreme Court directed the central government along with all the states to take preventive, punitive and remedial measures to stop lynching incidents and to ensure that law and order is maintained in future. It also has issued detailed guidelines regarding the same. The Court urged the Parliament to enact a separate law to deal with the offence of lynching.
