All attempts of fabrication in vain; Pakistan criticised by ICJ for denying Kulbhushan from basic human rights

New Delhi, July 17: Well-known for fabricating issues and trying to play safe, naive Pakistan has always fallen on its face. Exhibiting another trial of the same act, Pakistan on Wednesday was slammed by the International Court of Justice for breaching obligation incumbent upon it, by not informing Jadhav of his rights under Article 36 of Vienna Convention.

 

Claiming hard that their security forces arrested Jadhav from restive Balochistan province, Pakistan was adamant on its decision alleging him as an Indian spy. Denying all fabricated attempts made by Pakistan, India stood robust citing that Jadhav was a civilian who was kidnapped and moved to Pakistan by armed groups.

Pakistan stated that Jadhav entered Chabahar with a visa stamped on a fake passport in 2003 where he got a new identity of Hussain Mubarak Patel, born in 30 August 1968, from Maharashtra. The Pakistani officials further claimed that his job was to destabilise Pakistan by strengthening a separatist movement in Balochistan and Karachi. The Pakistani military court however had sentenced death penalty for Indian national Kulbhushan Jadhav based on "extracted confession" was been questioned by India in the International Court of Justice.

Stooping down to great levels, Pakistan during the joint conference held by the army and the government, a video confession by Jadhav was made public. Jadhav in the video alleged to have said that the Indian intelligence agency RAW was involved in destabilising Pakistan. He also said that he was a serving officer of the Indian Navy and was working in Pakistan at the behest of the RAW.

In its verdict, the ICJ held that Pakistan violated Article 36(1) of the Vienna Convention by not providing consular access by Indian officials to Jadhav, directing the neighbouring country to inform Jadhav of his rights provide consular access to him “without further delay”. The Court added that Pakistan is under an obligation to inform Kulbhushan Jadhav without further delay of his rights and to provide Indian consular officers access to him in accordance with Article 36 of the Vienna Convention on Consular Relations.
