New Delhi, February 27: Responding sharp to the Congress's blatant criticism over the transfer of Justice S Muralidhar from the Delhi High Court, Law Minister Ravi Shankar Prasad on Thursday said that the transfer was ordered on the recommendation of the Supreme Court collegium headed by Chief Justice of India SA Bobde and was carried out with the 'consent of the judge'.
 
This is hours after he roasted Delhi Police for not acting against hate speeches. “The well settled process have been followed", Prasad said in a string of tweets before launching a sharp counterattack at the Congress that has linked the judge’s transfer to his biting criticism of Delhi Police at a hearing on Wednesday.

Prasad said the Congress had displayed its scant regard for the judiciary by politicising a routine transfer. “People of India have rejected Congress Party and hence it is hell bent on destroying the very institutions India cherishes by constantly attacking them,” he tweeted.

Record of Congress in compromising independence of judiciary, superseding judges even of Supreme Court during Emergency is well known.They rejoice only when the judgment is of their liking otherwise raise questions on the institutions itself. Those raising questions do not respect the judgment of the Apex Court pronounced after elaborate arguments. Does Rahul Gandhi consider himself above even the Supreme Court?", he added.
The Congress on Thursday blatantly launched scathing attack on the Modi government over the transfer of Justice Murlidhar who asked Delhi Police on Wednesday to register FIR against leaders involved in making hate speeches. "BJP feared that the conspiracy of the riots will get exposed and this is the reason why the Justice Murlidhar has been transferred", said Congress spokesperson Randeep Surjewala adding that the transfer is an attempt to save BJP leaders against whom Murlidhar had made strong observations.

Justice S Muralidhar, who heard the petitions on Delhi violence on Wednesday, has been transferred to the Punjab and Haryana High Court. President Kovind has ordered the transfer following the recommendation by Supreme Court. A notification issued by the Ministry of Law and Justice announced that the President has taken the decision after consulting the Chief Justice of India.
 
Justice Muralidhar also held a late-night hearing at his residence on Tuesday midnight and asked Delhi Police to ensure safety of all those who have been injured in Delhi violence and need help. The Supreme Court had recommended the transfer last week, following which the Delhi High Court launched a protest against the move. The Supreme Court collegium had recommended the transfer of 3 judges on February 12, 2020. The notifications for these transfers were issued late on Wednesday night.
