Delhi HC terms Juhi Chawla’s suit against 5G technology ‘defective’, says ‘filed only for media publicity'

Delhi, June 02: Delhi High Court heard the case filed by Juhi Chawla against setting up of 5G wireless networks in the country, and termed the case as defective saying that the case was filed for “media publicity."  During the hearing, Justice J R Midha said, "Even if I agree with you that permission is to be given, permission for what? A defective plaint! This appears to be a media publicity suit nothing else than that. It's shocking Mr. Khosla."

The court also slammed Chawal for filing the suit without even giving any representation to the government on her concerns related to the technology. “Did you approach the government with a representation? If yes, is there any denial?” the court asked. Midha further added the plaintiffs, Chawla and two others, were required to first approach the government for their rights and if denied, they should come to the court.

The court further added that "No document is to be reproduced. No reports can be permitted to be reproduced. Order 6 Rule 2 has gone to winds. Order 2 Rule 9 has gone to winds, Law relating to Cause of action and joinder of parties has gone to winds, Demand of Justice is not there. I am quite surprised."
 
 
 
The court said in the suit, the plaintiff says ‘I have personal knowledge of paragraphs 1 to 8’ only. “Plaintiff has no personal knowledge of the plaint. I am surprised. How can it be? Is the suit permissible when the plaintiff has no personal knowledge of the averment? I have not seen a suit where a person says I don’t know, please conduct an inquiry,” the judge said.
 
 
"I'm surprised. I have never seen such a suit where a person comes to court with no information and says come to conduct an inquiry. The whole thrust of the case is I don't know, this appears to be dangerous please conduct an inquiry and satisfy " Justice Midha remarked. The court further asked about the knowledge of plaintiffs on the facts and warned them to prosecute them for filing false claims.
 
Earlier this week, Juhi Chawal filed a petition against the roll-out of 5G telecommunication services in the country. In the plea Chawla has said that if the telecom industry’s plans for 5G come to fruition, no person, animal, bird, insect, and plant on earth will be able to avoid exposure, 24 hours a day, 365 days a year, to levels of RF radiation that are 10x to 100x times greater than what exists today.
