The division bench comprising of Chief Justice S Manikumar along and justice P Chaly dismissed this appeal.

On August 6, the Single Bench stayed the decision of the state government after observing that only the President had the right to expand the list. The Bench also held that the government decision of inclusion of the community in the list went against the spirit of the Supreme Court verdict in the Maratha reservation case.

Following the State, the government had submitted a plea saying that the single judge should have taken note of the fact that Nadars belonging to Christian denominations other than the SIUC had already been included by the Central government in the Central List of OBCs.
