Justice SM Subramaniam said that residential assistants can be appointed for IPS officers but trained constables should not be used as orderlies to do domestic work. The court said it is illegal to use uniformed personnel for this purpose.

The court stated that cases must be registered against those officers who use constables as orderlies and can even book them in a criminal case if need be.

Justice Subramaniam said trained constables receive salaries of approx Rs 45,000 and using them as orderlies must stop forthwith. The court has ordered all orderlies to be withdrawn. K Phanindra Reddy, the Tamil Nadu Home Secretary, informed the Madras HC that he has directed the DGP to address the issue and file a report in four weeks.

The high court has instructed that orderlies appointed in the residences of retired police officials must also be removed immediately. The court has adjourned the case by six weeks for the government to file a status report.
