New Delhi , October 27 : A formal criminal complaint has been filed against Congress President Mallikarjun Kharge over two alleged incidents involving inflammatory and objectionable public statements, seeking the registration of a First Information Report (FIR) under relevant provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, and other applicable laws.
According to the complainant, the first incident relates to Kharge's speech at Nilambazar in Assam in April 2026, during which he allegedly described the Rashtriya Swayamsevak Sangh (RSS) and the Bharatiya Janata Party (BJP) as a “zehreela saanp” (venomous snake) and, while referring to namaz and the Quran, called for them to be killed.
The second incident concerns an alleged remark made by Kharge in Patna on October 25, 2026, in which he reportedly said, “Modi ka baap bhi jayega,” referring to the late father of Prime Minister Narendra Modi.
The complainant stated that such remarks by a senior political leader were a matter of concern and should not be dismissed as ordinary political discourse. The complaint argues that public platforms should not be used to make statements that could promote enmity or incite violence.
The complainant has sought the registration of an FIR under the relevant provisions of the BNS, 2023, and other applicable laws. The complaint also invokes the Supreme Court's directions concerning hate speech.
Emphasising accountability, the complainant stated that individuals must respect legal boundaries and that no person should be considered above the law, irrespective of their political position or affiliation.
The filing of the complaint marks a demand for legal action over the alleged remarks. Any criminal liability, however, would be determined through the appropriate legal process.
Further details regarding the police response, the registration of an FIR and any subsequent legal proceedings were not provided in the statement.
