T Raja Singh's acquittal has persuasive value in Nupur Sharma's case, however not binding: Advocate Karunasagar

On July 1, BJP leader and advocate Karunasagar stated that the acquittal of Telangana MLA T Raja Singh in a 2022 case concerning alleged remarks that hurt religious sentiments may hold persuasive value in the case against Nupur Sharma but is not binding on other courts.

Karunasagar, who represented T Raja Singh in court, told ANI that relief for Nupur Sharma depends on a proper investigation into her case. "Yesterday’s acquittal of MLA Raja Singh naturally leads many people to ask whether it has any bearing on the pending case against Nupur Sharma. The legal position is this: Nupur Sharma is also facing similar allegations for referring to material that she maintains is found in Islamic literature. This judgment is not binding on other courts, but it certainly has persuasive value regarding the importance of a fair and proper investigation. Whether the same reasoning ultimately benefits Nupur Sharma depends on it," he said.
 
 
 

This is after the Special Court for MPs/MLAs in Hyderabad acquitted Telangana MLA T Raja Singh in a 2022 case registered under multiple sections of the Indian Penal Code related to alleged remarks on religious sentiments. The case was registered under Sections 153A(a)(b), 295A, 504, 505(2) and 506 of the IPC.
 

“Today, the Special MP/MLA Court has acquitted MLA Raja Singh from the 2022 case, which PS Mangalat registered for allegedly commenting on the life of Prophet Muhammad. The complainant in the case has himself admitted that the alleged verses had reference to the Islamic literature… The court, after going through all the witnesses and evidence on hand, has approved that the case has not been made out against MLA Raja Singh and has acquitted him," he added.

Karunasagar added that the court found no grounds to proceed after examining witnesses and evidence in the case registered by Mangalhat Police Station. In 2022, multiple FIRs were filed against Nupur Sharma, then a BJP spokesperson, for her remarks about the Prophet Mohammed during a television show.
