Centre sets up ministerial panel to draft law to end instant triple talaq

New Delhi, Nov 21: The Narendra Modi government is weighing an idea of bringing legislation in the winter session of the Parliament to put an effective end to the instant triple talaq. This inhuman practice is in vogue until recently in the Muslim community to divorce spouse.

The Supreme Court had struck down this evil practice some time ago but in spite of this the practice was still in vogue.

The Union Government has set up a ministerial panel to propose a suitable and effective legislation or amend the existing penal provisions that would make instant triple talaq an offence, sources said.

According to the present existing law the victim of triple talaq or ‘talak-e-biddat’ have no option but to approach the police for redressal of her grievance as Muslim clergy would offer no assistance to her.

And the police find them helpless in taking action against the husband in the absence of punitive provisions in the law, sources said.

Therefore, the ministerial panel is formed to draft a new law or suggest an amendment to be produced in the winter session of the Parliament, the sources said.

The apex court had struck down the controversial practice of instant triple talaq as arbitrary and unconstitutional. This decision of the Supreme Court was hailed by the Muslim eves and social organisations like Muslim Rashtriya Manch (MRM).

Even after the SC judgement, there have been a number of cases of instant triple talaq and sources ascribe them to lack of awareness and absence of strong deterrent punishment in the existing law.

Despite advisories being issued to the members of the community against the archaic practice, there seemed to be no decline in the cases of divorce by 'talaq-e-biddat', sources claimed.

Soon after the SC judgement, the government said that a law on triple talaq might not be necessary as the order was now the law of the land. They felt that the provisions of the Indian Penal Code were sufficient to deal with cases when aggrieved women approached police.

In a recent case of 'talaq-e-biddat', a man working with a leading educational institution divorced his wife through WhatsApp and SMS, the functionaries said quoting media reports.
