Gulshan Kumar murder case: Bombay HC upholds conviction of Dawood aide

Mumbai, July 01: Almost 24 years after T-Series founder Gulshan Kumar's murder, the Bombay High Court upheld the conviction of gangster Dawood Ibrahim's aide, Abdul Rauf alias Daud Merchant in the murder case.
The HC bench of Justices Justice Jadhav and Justice Borkar dismissed the appeal filed by fugitive gangster Dawood Ibrahim and sentenced him to life imprisonment.

The court found him guilty under sections 302 (murder), 307(intention to kill), 34 (vicarious liability for crimes) of the IPC. The court also clarified he won't be entitled to any remission in his prison term.
 
During the hearing, the court observed that Rauf doesn't deserve a remission as he was an absconder immediately after the incident and was at large till 2001."The appellant (Abdul Rauf) should not be entitled to remission if any…He has criminal antecedents and continued in similar activities thereafter. In the interest of justice and society at large, appellant doesn't deserve any leniency," Justice Sadhana Jadhav said.
 
 
 
The court also asked him to surrender his passport to the police. It further warns that if he does not surrender the sessions court will execute a non-bailable warrant and take him into custody.
 
It should be noted that Abdul was absconding for a long time after the murder and was arrested in 2001. In March 2009, he again jumped on parole and went to Bangladesh. He was arrested in November 2016 from the Meghalaya border.

Notably, T-Series founder and Hindi film producer Gulshan Kumar was killed on 19 August 19, 1997, in Juhu. Kumar died on the spot after being shot 16 bullets. The police have termed the incident as a case of business rivalry.

He had reportedly been getting extortion and threat calls from Dawood's close aide Abu Salem for quite some time before he was killed, but the music mogul refused to pay any money.
 
A total of 19 persons were arrested in connection with the murder including Tips owner Ramesh Taurani. Five years later, a trial court, however, found evidence to only convict Abdul and acquitted 18 others accused in the case. Merchant, who absconded after Kumar's murder, was arrested in 2001 and awarded life imprisonment in 2002.
