Mumbai, June 3: A Special Court in Mumbai awarded death penalty to a man accused of raping and murdering a 32-year-old woman in the Sakinaka area last September.
Additional sessions judge (Dindoshi) H C Shende convicted accused Mohan Kathwaru Chauhan under IPC sections 302 (murder), 376 (rape) as well as provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act on May 30.
The prosecution demanded capital punishment for Mohan Chouhan (45) saying this offence falls under 'rarest of rare' category. "This is an offence against a woman and that too a woman belonging to a scheduled caste that makes it more serious," advocate Mahesh Mule, appearing for prosecution, argued in court.
"This is a gruesome, diabolical attack on a hapless, lonely woman at odd hours of the night, thereby raising fear for woman's safety in a metropolitan city like Mumbai," he added.

According to police, Chouhan raped the woman in a stationary vehicle & injuries suffered by the victim were akin to the Nirbhaya gang rape case. The woman died the next day during treatment at the civic-run Rajawadi Hospital due to a heavy loss of blood. This had led to CM Uddhav Thackeray announcing a fast-track trial in the case.
Judge Shende said that in the instant case only maximum punishment will send a message to society. “To show leniency or mercy in the case of such heinous crime and to the accused who have shown no repentance or remorse after exhibiting an extremely depraved mentality would be a travesty of justice. Hence, though this court is fully aware of the irrevocable nature of the death penalty, this court has to award that sentence,” the order read.
