NCSC summons Jamia Vice-Chancellor in case related to the caste-based atrocities

Harender Kumar has filed two complaints before the commission. The complainant, Kumar, belongs to the Scheduled caste and faced discrimination by the university authorities and was illegally terminated from the university from his job as a guest teacher (computer) at the university-run school.

New Delhi, July 05: The National Commission for Scheduled Caste has summoned Najma Akhtar, the Vice-Chancellor of Jamia Millia Islamia, in a case related to the caste-based atrocities and debunking of the reservation of SC and ST in appointment and promotion. The commission has asked her to appear in person before the NCSC on July 19th, 2022.

Harender Kumar has filed two complaints before the commission. The complainant, Kumar, belongs to the Scheduled caste and faced discrimination by the university authorities and was illegally terminated from the university from his job as a guest teacher (computer) at the university-run school.
 
The NCSC is a quasi-judicial constitutional body under Article 338 of the Indian Constitution. It is learned that the Commission was constrained to issue the summons on account of the university’s non-compliance to previous notices served for a hearing in the matter.
 
The first complaint, vide file No. H-7HRD-7/2018/SSW-II, is related to the conspiracy hatched against the petitioner, Harender Kumar by the Principal of Jamia School in cohort with the top officials of the university. He was dismissed from his tenure based on a fabricated complaint manufactured by the principal against him through a female teacher-pupil. The genesis of the complaint was deeply embedded in caste and religion-based discrimination as he resisted doing menial work of making tea and washing the utensils for the principal and public denigration of his identity.
 
 
Interestingly, after the direction of NCSC on the matter, a three-member committee was constituted to look into the fact. The committee had already submitted its report to the Executive Council and the complaint letter of the principal was withdrawn after fighting for nearly four years without any support or financial assistance and living constantly with the stigma of false accusations.
 
Harendra, on being asked how he looks at the whole event and what his experiences are in Jamia, broke down and narrated the graphic details of the events leading to his dismissal from the service, "I was asked to wash the left over utensils in the Principal’s chamber and prepare tea for him and his guests. Mursaleen, the Principal would be demeaning me for every petty issue and would tell me that I have occupied one seat of Muslim and I don’t deserve to be in the school because I am a Hindu and that too a scheduled caste. He would often say that he has got enough contacts in the university administrations and I would be shown door if in case I disobey him in any manner. He once forced me to download porn video in his mobile to which I straightaway denied. He took ill of it and started abusing me with caste signaling words 'Chaamar, Mai tere carrer ko khatam kar dunga, haraami ke pille' The matter was put under control by the interventions of some school teachers". I thought the matter is over but he hatched a conspiracy to terminate me by fabricating a complaint of sexual harassment against me by a female teacher pupil and forcing me to sign on an apology letter on a very different matter as I was threatened to get my job terminated and being the only bread earner for my family, I signed a letter dictated by him. He used this letter with his personal remark about my character to get me terminated without following any laid down guidelines. I was never asked to explain over the matter and was handed over my dismissal letter most unlawfully."
 
 
"I had borne the most excruciating humiliation that too from an institution where I myself got educated. I represented number of times before the competent authorities to let me know my fault, the exact reason for my termination and character assassination. Nothing yielded in any response, I was not even allowed to enter the university campus and treated as a pariah. After so much a painstaking efforts and running from pillar to post, I was able to get FIR registered against the Principal through the Saket court and simultaneously filled my representation before the NCSC in favour of justice. It was not at all acceptable for me to live under constant humiliation and stigma, I thought of committing suicide and end my life but thinking of my old parents, I could not take that step. The university administration is making no stone unturned in saving the accused. They did not even shared the entire report of the three-member committee and very shrewdly let that principal retire without any disciplinary action against his malicious and concocted letter which was withdrawn by the Executive Council of the university. Moreover, I was disallowed to know the status of my complaint. The principal on other hand had the audacity to go to my village and threatened my parents to ask me to withdraw the case. I can only say that "Satyamev Jayete" and I will have the justice delivered to me," he added.
 
The second representation of Harender, vide file no H-13 on which the Vice-Chancellor has been summoned is related to the abolishing of the reservation for SC/ST in appointment and promotion in a public-funded Central University, Jamia Millia Islamia.
