West Bengal violence- National Policy to enable safe return of IDPs must; PIL filed against Assam govt

There's one reason to strongly object the violence because when it appears to do good, the good is only temporary, the evil it does is permanent! The state of West Bengal has been going through a disordered situation since poll results, where people especially the Hindus are at target unsupportive of the state. In fact, the persecution on Hindus in the state of West Bengal is probably State sponsored, so much so that people are breathed forced to migrate to Assam for self safety and well being.
 
In the latest development, it has been widely observed that the migrated people are moving on their way back to West Bengal where there is still no healthy environment for the persecuted to live. As reported earlier, under the regulations of West Begal Police and the State government, more than 600 families have become homeless, women have been molested, children are starving and living under fear, houses have been vandalised.

A PIL in this matter has been filed by Abhijit Sharma and Ravi Cheddilal at the Guwahati High Court against the action of the Assam Government wherein, the IDPs have returned from Assam to Violence inflicted West Bengal without following procedure related to safe return. Advocate(s) Pankaj Singh, Gautam Jha and Ditul Das here, have argued for a National Policy to enable safe return of the IDPs, in this case West Bengal.
 
According the United Nations, Internally Displaced People are those who are forced to leave their homes, places of habitual residence in particular as a result of or in order to avoid the effects of armed conflict, situation of generalised violence, violation of human rights or natural of human made disasters, and who have not crossed internationally recognised State border.
 
The government of Assam has been keeping such displaced people in situation of protracted displacement and for the time being also providing them durable solution such as food, shelter and livelihood. But the Assam government cannot keep such people in such situation for a prolong period. The Indian Government has no national policy to respond to conflict induced IDPs and the responsibility for protecting such people has been delegated to the State.
 
 
 
But where do this persecuted public go if State itself is attacking kids, women, looting houses? The persecuted people moving back to West Benagl now have been issued no offcial communication from the State of Assam which further becomes the point of concern. "A removal order shall only be issued where the authorities of the host state have considered all relevant information and are satisfied that compliance with the order, will not expose the person facing return to- a real risk of being executed, or exposed to torture or inhuman or degrading treatment or punishment", advocates Pankaj Singh, Gautam Jha and Ditul Das noted.
 
 
Earlier, the National Commission for Protection of Child Rights (NCPCR) taking cognizance of the violence on kids in the State of West Bengal demanded a detailed inquiry into the matter as well as against the errant Police officials who are involved in it publically. This is probably after SP Avijit Banerjee (Diamond Harbor), IPS, has been put back to the post after the state assembly elections. It is observed that he is unofficially relinquishing his duty to political leader of ruling party Jahangir Khan who is of criminal background.
