A court in Nashik recently
cited Lord Krishna's birth while granting bail to Nida Khan, an accused in the TCS Nashik BPO sexual harassment and religious coercion case, on the grounds of her pregnancy. Additional Sessions Judge K.G. Joshi noted that a child born in prison would carry a social stigma. Khan, who is five months pregnant, had been arrested in May for her involvement in forcing Hindu employee women in TCS to convert to Islam.
The judge drew a parallel to Krishna's own birth in captivity,
calling it a painful circumstance for any mother and child to go through. In the bail order dated July 6, as reported by Bar and Bench, Joshi reasoned that granting bail would spare the child that trauma and stigma, and that doing so served the newborn's overall welfare.
The court also pointed to the fact that the investigation was already complete and the chargesheet filed, leaving no grounds to keep Khan in custody, noting there was nothing left to seize or discover, and that prosecutors hadn't sought her custody for further investigation, meaning continued detention would serve no purpose.
After being granted bail, Khan asked the court to modify the order, which had originally required a ₹75,000 surety. She explained that she was pregnant and financially unable to pay, and that no one at home could arrange the amount right away, asking for it to be lowered. The court partly accepted her request, allowing her release on a personal bond of ₹75,000 along with an immediate cash deposit of ₹50,000, while giving her four weeks to furnish the full original surety amount.
The said decision by the court sparked outrage among social media users, with the latter slamming the judiciary for comparing the accused Khan to Lord Krishna's mother, Goddess Devki. "When one doesn't understand the difference between God's birth by a mother kept in captivity by her brother to save himself & a mother sent to jail for criminal activity going to bear a child, such utterance occurs," one of the users said.
"Lord Krishna's case doesn't apply here because his parents were both jailed, but not for any crime. Judiciary has to abideby "Ratio Decidendi" and not go looking for parallels based on personal sympathies and bias," another user wrote.
"Lord Shri Krishna was born in a prison cell in Mathura to save the world from the tyrant King Kansa. His mother was not a criminal; she was falsely implicated by King Kansa. So, please do not dare to insult Hindu culture."
What is the case against Nida Khan?Nida Khan was arrested on May 7, roughly six weeks after FIRs were registered against seven people accused of sexually harassing and pressuring Hindu women employees at a TCS BPO unit in Nashik, Maharashtra, to convert their religion to Islam. Before her arrest, her request for anticipatory bail had already been turned down by the court. Among her co-accused, Tausif Attar has since been granted bail, while Danish Shaikh's bail plea was rejected.
The complaint against Khan alleges that she supplied a burqa to the complainant, shared religious literature with her, installed Islamic apps on her phone, and visited her home to guide her in religious practices.
The case first came to light in March 2026, when a Dalit woman working at the TCS BPO unit filed a complaint against Danish Shaikh. She accused him of raping her under the false promise of marriage, along with sexual exploitation, harassment, and pressuring her to convert to Islam. In the aftermath, other women employees came forward with similar allegations, citing workplace sexual harassment, molestation, abuse, and insults directed at their Hindu faith by certain staff members at the same BPO. In total, nine FIRs were filed, with several of the women stating that their earlier complaints to the BPO's HR and management had been ignored.
